GENERAL - TERMS & CONDITIONS

1. About us

We are Train Direct, a company specialising in first aid and medical supplies. Full company details are provided at the end of this document.

2. Payment terms

These terms and conditions apply when you purchase goods through our website. Separate terms govern the use of our website. Please read these terms carefully and save a copy for your records, as we do not retain individual copies for transactions. These terms are available in English, French, German, and Polish.

3. Definition of a Consumer

The term Consumer refers to an individual acting for purposes wholly or mainly outside their trade, business, craft, or profession.

4. Eligibility to Purchase

Purchases are restricted to individuals and entities located within the United Kingdom.

Goods may not be purchased for the purpose of infringing our intellectual property or other legal rights.

If you are acting on behalf of a company or organisation, you confirm that you are authorised to act on its behalf.

5. Amendments to These Terms

We may update these terms at any time. Changes apply to purchases made after the effective date displayed above.

6. Important Warnings

You agree to ensure that:

  • Goods are used in accordance with the manufacturer’s instructions and applicable laws.

  • Goods are installed by suitably skilled and qualified individuals.

You are responsible for monitoring replacement schedules for parts, such as batteries and pads, including diarising expiry dates and noting warning signals. Alerts for replacements may be sent but are not guaranteed. Providing accurate and up-to-date contact information is your responsibility.

For enhanced effectiveness, we recommend training for potential users of defibrillators where feasible. Publicly accessible defibrillators should be registered with your local ambulance service and comply with their recommendations.

7. Providing Accurate Information

Ensure that your order details, including delivery address, are accurate and promptly updated if changes occur.

8. Forming a Legal Contract

Placing an order constitutes an offer to purchase goods from us.

Orders are placed by adding items to the shopping cart and completing checkout by clicking “Pay Now”. You can review and amend your order before submission.

A contract is formed when we send a confirmation email. If an item is unavailable, we will notify you and provide a refund if payment has already been made.

9. Payment Terms

Payment must be made in advance. Prices include VAT unless otherwise stated.

Delivery charges are shown at checkout and vary by method.

In the event of a pricing error, we will notify you. If you choose not to proceed, a full refund will be issued.

Disputes over payments must be communicated to us immediately.

If payment is withheld or charged back without justification, we may terminate the contract and notify you in writing.

10. Discount Codes

Discount codes apply to product prices excluding delivery charges and are non-transferable. Unless otherwise specified:

  • Codes cannot be used retrospectively or combined with others.

  • Codes expire 12 months after issuance.

We reserve the right to reject or modify discount codes at our discretion.

11. Delivery

Delivery is complete when goods are delivered to the specified address. Orders may arrive in separate shipments.

Delivery is subject to geographic restrictions noted on our website. Orders to unsupported locations may be cancelled.

Delivery times are estimates and subject to delays outside our control.

You must promptly arrange redelivery if a delivery attempt is unsuccessful.

If goods are returned due to non-compliance with delivery requirements, you are liable for associated fees.

Non-Consumers must inspect goods upon receipt and report defects within seven days.

 

12. Ownership of Goods

Ownership transfers upon delivery and payment completion. Non-Consumers must store goods separately and identify them as our property until ownership transfers.

13. Consumer Right to Cancel

Consumers may cancel orders within 14 days of receipt, subject to the conditions detailed in the Annex below. This does not apply to certain sealed goods, such as AED batteries and pads, once unsealed.

14. Resale of Goods

Resale and promotion must comply with applicable laws.

Recommended retail prices are indicative only unless legally specified.

Goods and branding must not be altered without our consent.

Resale must not harm our reputation.

Representations about goods must not be made on our behalf without written consent.

15. Liability Limitations

Nothing in this agreement limits our liability for death, personal injury, fraud, or other matters that cannot legally be excluded.

 

Consumers retain statutory rights for goods that are faulty or not as described.

Non-Consumers:

  • Liability is capped at the price of the goods.

  • We are not liable for indirect or consequential losses, including lost profits or data.

16. Force Majeure

We are not responsible for delays or failures due to circumstances beyond our control, such as telecommunication failures or pandemics.

17. Contract Transfers

We may transfer rights and duties under this agreement if your rights are not prejudiced. You may not transfer your rights without prior consent.

18. Privacy Policy

We process personal information as outlined in our Privacy Policy, which may change over time.

19. Governing Law and Jurisdiction

These terms are governed by English law, and disputes will be resolved in UK courts.

20. General Information

Notices will be sent via email to the most recent address provided. Ensure your contact information is accurate.

Headings are for reference only and not legally binding.

If any part of this agreement is unenforceable, the remainder still applies.

No waiver of breaches affects the right to act on future breaches.

This agreement does not create an agency, partnership, or employee relationship.

ANNEX: Consumer Right to Cancel​

1. You have the right to cancel within 14 days of receiving goods without giving a reason.

2. Cancellation must be communicated via email or post.

3. We will refund payments, including standard delivery costs, within 14 days of receiving returned goods or proof of return.

4. Goods must be returned within 14 days of cancellation, and you bear the return costs.

5. You are responsible for any diminished value of goods due to handling beyond what is necessary to assess them.
